1. Acceptance of Terms
This platform is run by Martin Frelih s.p. (Godovič 54a, 5275 Godovič, Slovenia, VAT ID: 35088982). By accessing and using the Kastellan platform ("Service"), whether through our primary domain or a white-labeled instance managed by one of our partners ("Tenant"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by these terms, please do not use this Service.
2. AI Services and Output
2.1 Nature of AI Services. The Service provides access to artificial intelligence tools and capabilities ("AI Services"). You acknowledge that AI Services use probabilistic models to generate content ("Output") based on your inputs ("Input").
2.2 Ownership of Output. As between you and us, you own all right, title, and interest in and to your Input and the resulting Output. You are responsible for ensuring your Input does not violate any third-party rights.
2.3 Accuracy and Reliability. Artificial intelligence is a rapidly evolving field. We work constantly to improve our Services to make them more accurate, reliable, safe, and beneficial. However, given the probabilistic nature of machine learning, use of our Services may in some situations result in incorrect Output that does not accurately reflect real people, places, or facts. You should evaluate the accuracy of any Output as appropriate for your use case, including by using human review of the Output.
3. User Responsibilities
You agree not to use the Service to:
- Generate content that is illegal, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, or invasive of another's privacy.
- Represent that AI-generated Output was human-generated when it was not.
- Use the Service for automated decision-making that produces legal effects concerning individuals or similarly significantly affects them.
- Reverse assemble, reverse compile, decompile, translate or otherwise attempt to discover the source code or underlying components of models, algorithms, and systems of the Services.
4. Intellectual Property
The Service and its original content (excluding User Input and Output), features, and functionality are and will remain the exclusive property of Kastellan and its licensors. The Service is protected by copyright, trademark, and other laws.
5. Limitation of Liability
To the maximum extent permitted by law, in no event shall Kastellan, its affiliates, agents, directors, employees, suppliers, or licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, this Service.
6. Indemnification
You agree to defend, indemnify, and hold harmless Kastellan and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.
7. Service Availability and Modifications
We reserve the right to withdraw or amend our Service, and any service or material we provide via the Service, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Service is unavailable at any time or for any period.

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

10. Refund Policy
10.1 14-Day Money-Back Guarantee
We offer a 14-day, no-questions-asked refund policy for first-time purchases of Kastellan subscriptions.
If you are not satisfied with the Service, you may request a full refund within fourteen (14) calendar days of your initial purchase.
Upon approval, the refund will be issued to the original payment method used for the transaction.
After the 14-day period has expired, payments are non-refundable except where required by applicable law.
10.2 Weekly Subscription Billing
Kastellan operates on a recurring weekly subscription basis.
By subscribing, you authorize us to automatically charge your selected payment method once every seven (7) days until you cancel.
You may cancel your subscription at any time through your account settings.
Cancellation will stop future billing, but does not automatically trigger refunds for previous payments outside the 14-day refund window.

Refunds will be processed to the original payment method used for the purchase.
10.4 Payment Processing
All payments are processed by our merchant of record, Paddle.com. Refunds are issued in accordance with Paddle's refund policies and processing timelines.

4.2 Training Data. We do not use your Inputs or Outputs to train our foundational AI models. Your data remains yours and is used only to provide the Service to you.
